New tank standards take effect for hazmat carriers

The rule applies to cargo tank motor vehicles, cryogenic portable tanks, and ton tanks. Carriers may follow the updated standards starting September 28, 2026, with full compliance required by October 28, 2026.
A final rule updates the standards for building and maintaining hazardous materials transport tanks. The change allows carriers and manufacturers to use the 2015 edition of ASME Section XII and the 2015 National Board Inspection Code. These standards now serve as approved alternatives to older requirements.
The update covers specific cargo tank motor vehicles, cryogenic portable tanks, and multi-unit tank car tanks. Authorized tank specifications include MC 331, MC 338, DOT 406, DOT 407, DOT 412, UN T75, DOT 106A, and DOT 110AW. Carriers operating these tanks can now choose the newer standards for construction and continued service.
Voluntary compliance begins on September 28, 2026. The rule becomes mandatory on October 28, 2026. The agency states the change is deregulatory and will not add new costs. It estimates annual net savings of about $8.1 million for the regulated community.
The older ASME Section VIII, Division 1 standard remains available for use. Carriers are not required to switch to the new standards. The update simply adds options for tank construction and inspection while keeping existing safety requirements in place.
