New DataQ rules for contesting inspection violations are now active
The changes apply to all states and take effect immediately. Company drivers and leased owner-operators may now submit their own challenges directly.
New rules for handling disputed roadside inspection violations are now active. The changes standardize how state agencies process DataQ challenges across the country. The requirements are effective immediately.
Federal officials announced the requirements in April to fix past inconsistencies. The goal is to make the review process faster and more fair for drivers who believe a citation was issued in error.
Company drivers and owner-operators working for a carrier can file challenges on their own. Drivers must create a DataQ account to submit a dispute.
Disputed violations affect both carrier safety scores and individual driver files. Those files are used during background checks for new jobs.
Drivers can request their own records through the Pre-Employment Screening Program for a fee, or through a Freedom of Information Act request at no cost.
