FMCSA seeks comments on fireworks company HOS exemption request

A fireworks company has asked to change how the 14-hour duty window is calculated for its drivers. The Federal Motor Carrier Safety Administration is asking for public comments on the request from Precision Fireworks LLC. Under the proposal, drivers could exclude off-duty and sleeper-berth time from the 14-hour limit. This would apply to about five drivers transporting fireworks for Independence Day displays between June 28 and July 8. The exemption would cover the years 2026 through 2031. Drivers would still follow the 11-hour driving limit and the 60- and 70-hour on-duty limits.

The company says it cannot find enough qualified drivers to meet the strict 14-hour window. It also warns that denying the request could lead to unsecure parking of hazardous materials. The company states it has had zero reportable crashes in the last ten years during the holiday season.

Carriers and drivers can submit comments on the request. Comments must be received on or before August 31, 2026. Submissions should include docket number FMCSA-2026-1520. FMCSA will review the application, safety analysis, and public comments before deciding whether to grant or deny the exemption.
