FMCSA denies CLP exemption request over hazmat safety concerns

The agency rejected a carrier’s application to let permit holders drive alone after passing skills tests. The decision highlights strict limits on moving placarded materials without proper endorsements.

A recent request to let commercial learner’s permit drivers operate without a licensed supervisor was denied. The decision applies to Agri-Tech Aviation, an Iowa company that transports jet fuel and crop protection chemicals.

The carrier submitted the application in November 2025. It operates five commercial vehicles and wanted drivers who passed the skills test but lacked the physical license to drive independently. Company leadership stated the waiver would give drivers practical experience while they finished their Class A licensing.

The agency published its denial on September 30. It received thirty-eight public comments, and none supported the request. One commenter warned that the waiver would increase public risk without providing benefits.

The denial focused on safety problems related to hazardous materials transport. Federal regulations prohibit learner’s permit holders from receiving a hazmat endorsement. The agency noted the carrier failed to explain how it would maintain safety standards while moving placarded materials with unendorsed drivers.

This outcome follows several previous approvals for other carriers. The agency maintains that permit holders cannot transport placarded hazardous materials without the proper endorsement, regardless of skills test results.
