FMCSA DataQ Overhaul Now Live in All 50 States
Small carriers and drivers can now contest safety violations through a three-stage independent review with set response timelines.
FMCSA confirmed on October 15 that updated DataQ review requirements are in effect across all 50 states, Washington, D.C., and U.S. territories. The change gives drivers and carriers a structured path to dispute safety violations they believe are wrong.
Under the old system, a common complaint was that the individual or office that raised a violation also ruled on the appeal. The new rules require states to run a three-stage independent review, so the decision-maker is separate from the one who originally flagged the issue.
The agency also set new timeline standards for how quickly each stage must be handled, addressing long-standing complaints that challenges could sit unresolved for months. The revised framework is described as a leaner process for processing data review requests.
FMCSA Administrator Derek Barrs told the industry the changes deliver on a prior commitment: "We promised the trucking industry that we would strengthen the DataQs process by improving timeliness and enhancing due process."
The Owner-Operator Independent Drivers Association had been pressing for these changes, citing the lack of due process in the prior system.
To file a challenge, a driver or carrier must have a DataQ account set up. OOIDA members can get help filing by calling 816-229-5791.
