The broker proposal has been with the Office of Management and Budget since August and was marked for a July target date. It followed a 2020 driver protest and a petition from the Owner-Operator Independent Drivers Association.

Several pending rules for carriers and drivers are expected to move forward, including a broker-transaction transparency proposal tied to broker record access.

In March, Derek Barrs, the FMCSA administrator, told the U.S. Chamber of Commerce Keep America Moving Summit that the agency intended to move quickly on rulemaking in 2026. He said the agency would try to push out about nine rules that year.

During the summer, the agency issued a final rule that eases reporting requirements. It also proposed stronger enforcement of English-language proficiency.

FreightWaves reported on Oct. 26 that Jesse Elison, with FMCSA, told the Future of Freight Festival audience that several rules would come soon.

The broker transparency item has been with the White House Office of Management and Budget since August. It has been there for more than two months. It is a supplemental notice of proposed rulemaking on transparency in broker transactions.

Regulation 371.3 requires brokers to keep records of each transaction and gives each party to a transaction the right to review the record. Brokers sometimes avoid that by requiring waivers or by telling truckers they must visit a physical office.

The regulatory agenda marked July as the target date, and the proposal is labeled economically nonsignificant, a category that often makes OMB review unnecessary. After White House approval, the proposal would appear in the Federal Register, and a public comment period would start.
